Hi guys,
A few weeks ago we found out Rosie had FHO and needed surgery. AT the time, I was in shock. The vet had told us so many times that it was her patella. So since I didnt want her to suffer of pain so I decided to go ahead with the surgery. I don't have money laying around but her health was my priority. So on Thursday she went into surgery. The vet said she did good. But after seeing her being cut, I felt so angry. Not at the vet but at the breeder. I have tried reaching her but she seems too be voiding my calls. I spent so much on Rosie which were genetic problems and feel like the breeder should be held responsible. It makes me so mad how she can breed dogs that are sick plus let these poor babies go through this. Is there anything I can do about the breeder? Anyways,Rosie is doing a bit better. Her leg is not as swollen, she had taken a few steps with her leg. I tried keeping her to stay still but she cries and jumps,. Her wound started to bleed a bit I need to seriously cage her but my hubby lets her out. I hope she gets better soon. It seems really painful

There is quite a bit to address in your missive.

First a couple of questions? 1) How old was your dog when she underwent surgery?
2) Did you have a health guaranty.. and was it signed by the breeder?

Then if your health guaranty warrants against genetic defects (you need to read the language used); you should have a valid claim against the breeder.

Also there may be a puppy lemon law in your state. Google it and see what if anything it says.

What I think is fair under these conditions is a full refund of the purchase price of the dog.

I would do the following after finding out what exactly you have in paperwork and what the laws are in your State.

Send a registered letter to the breeder, along with photocopies of the diagnosis, and photocopies of the bills. I would state my case clearly and succinctly, outlining what You feel is adequate compensation for what you and your puppy has experienced. And when you expect a reply and the settlement to be paid to you.

Next I would find "free" or very reasonable legal aid, and outline the situation to them, to see what your remedies are under the law.

Regrettably Leggs Perthes disease (which is genetic in all breeds) is rearing its head in our Yorkies. This is something which has been talked about here, and is something each purchaser who informs themselves would be aware of the possibility of.

Just for example did you ask about the health clearances the breeder had done on the breeding dogs? Did you follow up and check the relevant databases? Were the dogs she breed certified by offa to be clear of hip dysplasia and Leggs Perthes?

Purchasing a dog, like any other major purchase is governed by Caveat Empror. Let the buyer beware.

Finally you and your husband need to know that the quality of her recovery is dependent upon keeping your dog quiet. No jumping etc. Get her into a crate where she can't jump. Walk her out to potty on a leash, etc.

So sorry to hear about Rosy. We are currently going through the same thing here. Our little Annie also had Legg Perthes Disease. She had her surgery last Thursday. It has been quite the road for us. She is starting to look better today. I uploaded a video today on YouTube of her progress on this 4th day. She is doing much better today. We do have our little hicups but so far, nock on wood it is going as well as can be expected. Here is the video I took today.

1) Rosie is only a year old
2) I read the health guarantee and it only covers for the first 7 days that we have her. It is partly our fault, I had a feeling she was a backyard breeder but my husband really wanted Rosie. The breeder's dogs were AKC registered and registered with the state. But we never bothered to research further. I just wanted to get in touch with her and tell her to stop breeding them! And for people to stop buying puppies from her

I sincerely hope everything goes well for her recovery. Stil lI would recommend a registered letter to her outlining your gal's problems.

I did look up the lemon laws in PA which are almost useless, as you only have 10 days to report genetic defects, and most take a whole lot longer than that to materialize.

So send that letter; and if no response to you; then do a breeder review here, and on yelp, and other reporting agency you can find.

When my Mylee had to have her FHO surgery I sent a copy of the veterinary diagnosis and phone number to the animal hospital where we go, and our veterinarian's name highlighted, a copy of my itemized vet bills because there were several different appointments from diagnosis to surgery date, with xrays, medications, and the surgery, and pictures of my baby with her hip shaved and a 3" scar. Thank you for asking she is doing good. Her cut looks like its closing. Her stitches should be out on Monday. But the vet didn't mention anything about her rehabilitation, but I saw you posted that Annie will be swimming to exercise that leg. I think I'm going to do the same thing for Rosie once her stitches are out does Annie still fuss?
