| I am so mad!!!!!!! My lease is up on my apartment on May 19th. They require 60 days written notice that I am not renewing my lease. Well I did notifiy them months ago when I found out my Fiancee and I were getting out house. Well, we moved into our new house 3 weeks ago, and we decided to just pay out the lease since breaking it would cost us more money. Well today I call the apartments to see how much May's rent would be since it will not be a full months rent. Well they have lost my written notice and say I am responsible for the rent until June 18th now. Of course I explained to the "new manager" (which I did not know that we had a new one) that I included the notice in with one my rent checks (i don't remember which one and have no idea where the copy is being everything is still in boxes), and I even spoke to one of the assistant managers telling them I was not renewing my lease. Well I guess none of this matter because the manager still says I will be responsible for the rent until June 18th since she does not have the written notice in the file. Isn't that abunch of BS!!!!!! To top it off we do not have the complete months rent to give them because our 1st house payment is due May 1st. I hate appartment management companies, they do not work with you on anything. All they want is more money and want to rent the apartment out to get double the money. | I would be mad too that sucks! Is there any way to get into contact with the old manager? I would be putting a HUGE fuss about that! Hope you figure it out

| I wish, but the it is a corporate management company. The manager did say that if she could rent the apartment out before June 18th she would give me my money back and I could keep the keys until then. I asked her to put that all in writing for me. It still does not fix the problem that we do not have the money to give them because we were expecting to pay $600 not $1000. Also, I just called my fiancee and told him what is going one and he is pissed. He said that he was going to call and talk to them about it. He thinks that since they lost the notice, we should not be responsible for anything. |

| I think he is right, I would be arguing until they let you off the hook for the money, call everyday if you have to. If they lost it it is their fault! Good luck!

| The corporate management company should be able to help you. I would call them, let them know whats going on. It just might be on their file. Look for your copy when you can. I would send in the rent you think you should send, and let them take it from there. Make sure you write in the memo on the check, last months rent paid in full. If they cash it, there will be nothing they can do, if they don't, it will take months to go in court, and you're going to win anyway, so let them waste their time. This is why we do our own apartments, we know whats going on. When you have a management company things get lost. Best of luck to you!!!!

| I put the notice with the rent check in March, I think I have a copy of it somewhere. I am going to look for it to night when I get home. It just irritates me that one of the girl's from the leasing office called me and confimed that we were not renewing. To make matter worse all the people that worked in the apartment leasing office are all new and all the ones we delt with in March are no longer there. I think they are trying to screw me, because a majority of the residents there are moving out and they can get anyone to lease the apartments. |

Include a note explaining that you did give them notice, and let them take you to court if they want. Then you can explain it to the judge, and if the judge says you have to pay then you have to pay. Finding the copy of the notice will not help much if you didn't mail it by certified mail because they could claim that yoyu just now made up that notice. There are companie out there that will do that cause most yhoung people get frightened and pay. But once you pay you will never get it back. They cannot get a judgement against you without first taking you to court. Be sure to give them the keys and maybe even get a receipt or them. Some management companies ar unscrupulous because they are paid on a commision. I manage my own property also. | |

| My fiancee just informed me that his friend had this same thing happen to him. His friend filed a motion against the appartment complex and won. It only cost him $35 dollars and he had to pay what the lease said not what they wanted him to. And the appartment complex had to pay all the court fees, so they were out more money than what they received. |

| The other thing you can do is put your rent payment in escrow until it gets straightened out. You'll be surprised how agreeable they can become when they realize they aren't getting their money right away. Also, they might assume you're considering small claims court and decide it's not worth their energy... especially if it was their fault to begin with. Good luck!

| i use to be a resident manager and if they rent the apartment out, you cannot be charged. they legally cannot take to rent cks for the same apt the same month. you need to speak w the upper management and write a letter. adv them you gave a written notice and they lost it....this is not do to your error its theirs. adv them you will put your money in escrow until they fix the problem. you can always call your local news station and spk w someone there about the rental laws in your state. dont let them do this to you!!!!

| Aww... that sucks. We had this happen to us too, met the landlords on the first to give them the notice. They seemed great until they never sent back our deposit in the 10 days they were suppose to. I kept calling them, they kept saying it was in the mail.... Then after about a month the jerks that seemed so nice kept our $1100 saying we did not give them notice. We had no proof. Boy was I mad, after that we alway gave notice in person, we would give the landlord one copy and ask them to sign and date another copy for us to have so this could not happen again. All the best! Don't give up, you deserve your money. |
